New York State Supreme Court Dismisses Case Against DDC

New York State Supreme Court Justice Michael D. Stallman has dismissed a lawsuit initiated by David Abraham against
Abraham, the club's former vice president, petitioned the court in February 2009 to void a vote by the DDC to change its December 2008 by-laws. Abraham claimed that many of the votes cast were by club members who had not paid their dues and brought the petition to the court on the grounds that failure to pay club dues resulted in automatic membership suspension, thus disqualifying a number of the votes tallied in a very tight December poll.
In reading all of Abraham’s papers, affidavits and briefs, Judge Stallman denied all of his motions and dismissed the case.
“We are pleased at the New York State Supreme Court’s decision,” said DDC Managing Director Dr. Martin Hochbaum. “The Court’s decision affirms that the vote on our by-laws was conducted honorably and that there was no finding of wrongdoing by DDC or Mr. Banda. We regret that Mr. Banda is not here to share in the Supreme Court’s vindication of our position.”
Jacob Banda died in October 2009.
